Policy Scope

 

 

This policy covers the Company’s actions in identifying and managing situations relating to alcohol, illegal drugs, non-prescribed and unnotified prescription medication, legal highs and substances that can impair a person’s mental and physical capabilities.

Policy Scope

Definitions

“Under the influence” relating to drugs and legal highs:

A drug test displays a non-negative result.

“Under the influence” relating to alcohol:
A breathalyser test displays a result of 35 micrograms per 100 millilitres of breath or a person’s mental and / or physical capabilities are impaired.

“Serious Incident / Accident”:

An incident that involved a vehicle, an accident that resulted in a person being off of work and / or could potentially have resulted in a fatality.

“Impaired”:

The individual is displaying signs that their mental health and / or physical capabilities are affected.

“High Risk Activities”:

An activity that the Company has defined as being potential dangerous, possibly resulting in serious harm to staff or others working around them i.e. Fork Lift Truck Drivers, Vehicle Drivers, Installation Engineers, Remedial Engineers, and Machinery Operators

Policy Details

The Company is committed to providing a safe working environment for all staff, visitors, contractors and members of the public. To help it achieve this goal, it uses the following testing regimes:

 

-Following a serious incident / accident

-When there is justifiable reasons to suspect a person is under the influence

(also known as “For Cause / With Cause”)

-Annual testing of staff that complete high risk activities

To ensure that the Company’s rules concerning alcohol, illegal drugs, non-prescribed and unnotified prescription medication, legal highs and substances that can impair a person’s mental and physical capabilities are clear, the following rules have been established concerning these areas:

 

-Anyone reasonably suspected to have consumed or be under the influence of effects alcohol on site may be suspended on full pay, pending an investigation and formal disciplinary hearing.

-Anyone reasonably suspected to be consuming or to be under the influence or effects of, in possession of, buying and / or selling of illegal drugs, non-prescribed medication, legal highs and / or substances that can impair a person’s mental and physical capabilities may be suspended on full pay, pending an investigation and formal disciplinary hearing.

-Anyone that displays signs that their mental and / or physical capabilities are affected, which could affect their health and safety or of those around them, without a justifiable reason may be suspended on full pay, pending an investigation and formal disciplinary hearing.

Company Rules - Part 1

To ensure that the Company’s rules concerning alcohol, illegal drugs, non-prescribed and unnotified prescription medication, legal highs and substances that can impair a person’s mental and physical capabilities are clear, the following rules have been established concerning these areas:

-Anyone reasonably suspected to have tampered with a testing sample may be suspended on full pay, pending an investigation and formal disciplinary hearing.

-Anyone who refuses to provide a breath and / or urine sample for testing without justifiable reasons will be automatically assumed to have provided a non-negative test result and may be suspended on full pay, pending an investigation and a formal disciplinary hearing.

-Failure to report to a line manager a prescribed medication that could have an impact on a member of staff being able to complete their job safely will be investigated and may result in a formal disciplinary hearing.

EMPLOYEES SHOULD BE AWARE THAT THIS POLICY FORMS PART OF THEIR EMPLOYMENT CONTRACT

Drug, Alcohol, and Substance Abuse Policy

When a situation has arisen, a trained person will be required to assess the situation, with the outcome being either:

(1) Decision from the trained person that no testing required and the person(s) involved being able to return to work straight away

(2) The trained person being in agreement that testing is required, and the arranging of testing to take place

All testing will take place in quiet, private room and will be administered by the train person(s).

In the case of urine testing, the quiet, private room will ideally be located close to a bathroom.

Those suspected of being under the influence of alcohol will have to do a test using a breathalyser.

Those suspected of being under the influence of drugs will have to do a urine test.
