To provide public electronic access to copyrighted material
It worked out for a while......until....
DOJ (Department Of Justice) : Objection!
DOJ rejected the original proposed settlement concluded it is not a fair use due to its violations to copyright, antitrust and class action laws
Mitigation
Some take aways:
1. Do you think that Google should have taken a different approach that would have allowed it to avoid litigation and a lengthy delay in implementing its Book Search Library Project?
If Google established different approach that would have allowed it to avoid litigation and lengthy delay in implementing its Book Search Library Project. Because many of the books are protected under the copyright law. Google should have find a way to avoid problems with copyright infringement. If the Google’s project is permissible as a fair use, the proposed settlement would give Google the right to display the books online and to profit from them by selling access to individual text as well as selling subscriptions to its entire collection to libraries and other institution.
Implementing the Book Search Library Project without even informing the publisher as well as the authors of the book is an unethical. The publishers and the authors of the book should be informed beforehand.
2. As a potential user, are you in favor of or do you opposed the Book Search Library Project? Please explain your answer.
As a potential user, of course I am in favor with the implementation of the Book Search Library Project. Since it helps me to searching book easily, searching book without going to library but searching particular book online and searching book online for free.
3. Do you think that the proposed settlement gives Google an unfair advantage to profit from creating an online service that allows people to access and search millions of books?
I don’t think the proposed settlement gives Google an unfair advantage to profit from creating an online service. Because as what is stated, the proposed settlement would give Google a fair profit from it. The resulting revenue would be shared fairly among Google, authors and publishers. Also, Google is the one that has to maintain all the texts data in their database, earning some profit is reasonable.
