Title
"The institutionalization of collaborative and self regulatory capabilities for the networked society"
1. Effective mediatization of collaborative contract management experiences for the networked society
2. Usability and knowledge visualization for online dispute resolution processes. The institutionalization of collaborative and self regulatory capabilities for the networked society
3. ***Cooperation based competitiveness. Capturing value through contractual management experiences using technical interfaces. Measuring the usability of online consumer redress mechanisms. ***
general research questions
1. Has the role of private actors in the internet governance regulatory context effectively been established?
2. Are formal institutionalization processes of ADR effectively improving dispute resolution and conflict management competences or affecting transactional practices?
3. How to facilitate/induce collaborative negotiation and contractual experiences using innovative business model tools, technology, and usability principles?
research structure/design
Theoretical section:
1. Describing the context, explaining the multidisciplinary connections, integrating the theory (sociopolitical, organizational, managerial and legal aspects), proposing a common ground around collaborative competences
2. Identifying and developing concrete practical applications in the field of transactional models for companies (usable, efficient and effective contracts and technical applications), and legal education targets: transforming goals and methodologies towards a preventive and collaborative law for the digital economy, or a business model for legal services by design
Key uncertainties
Empirical possibilities:
1. Exploring the correlations of transactional usability, dispute resolution experiences, and collaboration.
Required prototype: a contractual model on an ODR interface. Study group of minimum 100 participants that would be using the system and discussing their experience.
2. Determining the level to which education and technology induce or facilitate transactional collaboration. Required instrument: interviews and questionnaires. Concrete methodology: IPSEUS and in depth interviews. Study group of minimum 30 participants who should have at least higher education.
Conceptual process development
- Global Governance
- Networked Society principles and perspectives
- Institutionalization processes
- Stakeholders
- Opportunities: participation
- Responsibilities: self-regulation
- Competences: collaboration
Applications of perspective: contractual experiences in dispute prevention and conflict management and/or a business model for legal services by design (start ups on law services).

specific HYPOTHESES
1. The contractual process experiences in dispute resolution and conflict management can be improved for customers
2. Computer interfaces can become a product/service offering in which transactions with customers could be pleasant, effective and collaborative.
3. Principles from information design and technology are applicable to Online contracting and Dispute Resolution platforms.
assumption 1
A piece of legislation, an agreement or a contract -in itself- is not the goal of a human transactional relationship, but relational transformation and successful implementation are.
assumption 2
Implementation, in turn, means adoption and action, often a change of behavior, on the part of the intended individuals and organizations
assumption 3
Contractual usability through legal visualization and collaborative interaction should incentivize compliance and facilitate contract management strategies. (boundary object theory? user centered design and iterative)
assumption 4
Collaborative interaction and legal visualization techniques can turn legal documents into usable products. These documents may consist of data, information, or knowledge.
